Please read these terms carefully before using Kaal (“the app”, “our app”). By downloading, installing, or using Kaal, you agree to be bound by these Terms & Conditions. If you do not agree, please do not use the app.
1. Eligibility
You must be at least 13 years old to use Kaal. By using the app, you represent that you meet this age requirement. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these terms.
2. Description of Service
Kaal is a sacred calendar app that provides:
- Daily panchang information (tithi, nakshatra, yoga, karana, muhurta)
- Festival calendar with observance guides and regional filtering
- Monthly calendar with auspiciousness scoring
- Personalized star alignment (Tara Balam) based on birth nakshatra (premium)
- Best Days planner with category filtering (premium)
- Mantras and observance guides (premium)
- Weather and sunrise/sunset times based on location
3. Informational Purpose Only
Kaal is provided for informational and cultural reference purposes only. The panchang calculations, auspiciousness scores, muhurta timings, star alignment results, and all other guidance and recommendations in the app:
- Are based on traditional Hindu astronomical methods using the astronomy-engine library for planetary calculations
- Should not be considered as professional astrological, religious, or spiritual advice
- Should not be the sole basis for important life decisions (financial, medical, legal, or otherwise)
- May vary from other panchang sources due to differences in calculation methods, ayanamsa selection, local horizon corrections, and regional traditions
- Are provided without any representation of completeness, accuracy, or fitness for any particular purpose
We do not guarantee the accuracy, reliability, or completeness of any calculation, score, or recommendation. You use this information at your own discretion and risk.
4. Subscriptions & Purchases
4.1 Free Tier
Kaal offers core panchang features at no cost, supported by advertisements served through Google AdMob.
4.2 KAAL ✦ Aligned (Premium)
Premium features are available through auto-renewing subscriptions managed by the Apple App Store or Google Play Store:
- Monthly: $1.99 USD per month ($49 INR in India), billed monthly
- Annual: $9.99 USD per year ($299 INR in India), billed annually, with a 7-day free trial for new subscribers
Prices are in USD and may vary by region due to App Store currency conversion. The price displayed in your local App Store at the time of purchase is the price you will be charged.
4.3 Billing & Renewal
- Payment is charged to your Apple ID or Google Play account at confirmation of purchase
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period
- Your account will be charged for renewal within 24 hours prior to the end of the current period at the same rate
- Free trial: If offered, any unused portion of a free trial is forfeited when you purchase a subscription. The free trial is available once per Apple ID/Google account
4.4 Cancellation & Refunds
You may cancel your subscription at any time through your device’s subscription settings:
- iOS: Settings → [Your Name] → Subscriptions → Kaal
- Android: Google Play Store → Subscriptions → Kaal
Cancellation takes effect at the end of the current billing period. You retain access to premium features until then. No refunds are provided for partial billing periods. Refund requests for exceptional circumstances may be submitted directly to Apple or Google through their standard refund processes.
5. Apple App Store Terms
If you downloaded Kaal from the Apple App Store, you acknowledge and agree that:
- These Terms are between you and us (not Apple), and we are solely responsible for the app and its content
- Apple has no obligation to provide maintenance or support for Kaal
- In the event of any failure of the app to conform to applicable warranties, you may notify Apple for a refund of the purchase price (if any); beyond that, Apple has no warranty obligation
- Apple is not responsible for addressing any claims relating to the app or your possession/use of the app
- In the event of any third-party intellectual property claim, we (not Apple) are solely responsible for the investigation, defense, settlement, and discharge of such claim
- Apple and its subsidiaries are third-party beneficiaries of these Terms, and Apple will have the right to enforce these Terms against you
- You are not located in a country subject to a U.S. Government embargo, or designated as a “terrorist supporting” country, and you are not on any U.S. Government list of prohibited or restricted parties
6. Intellectual Property
All content in Kaal — including but not limited to the design, source code, graphics, animations, logo, brand names “Kaal” and “KAAL ✦ Aligned”, the Kaala design system, Panchang Rings brand mark, and the app interface — is owned by us and protected by applicable intellectual property laws.
Festival descriptions, mantras, slokas, and traditional knowledge included in the app are drawn from publicly available Hindu scriptures, texts, and cultural traditions, and are presented for informational and educational purposes.
You may not copy, modify, distribute, sell, lease, or create derivative works based on the app or its content without our prior written consent.
7. User Conduct
You agree not to:
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the app
- Use the app for any unlawful purpose or in violation of any applicable laws
- Attempt to gain unauthorized access to any part of the app or its related systems
- Redistribute, republish, or commercially exploit the app’s content without permission
- Remove, alter, or obscure any copyright, trademark, or other proprietary notices
- Use automated systems (bots, scrapers) to access or interact with the app
8. Disclaimer of Warranties
KAAL IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The app will be uninterrupted, error-free, or free of harmful components
- Panchang calculations, muhurta timings, or auspiciousness scores will match other sources or meet your specific requirements
- The app will be compatible with all devices or operating system versions
- Third-party services (weather, maps, analytics) will be available at all times
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES.
OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID US FOR THE APP IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
10. Indemnification
You agree to indemnify, defend, and hold harmless Kaal and its creators from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to your use of the app, your violation of these Terms, or your violation of any rights of a third party.
11. Third-Party Services
The app integrates with third-party services including PostHog (analytics), Google AdMob (advertising), Open-Meteo (weather), OpenStreetMap (nearby temples), and Apple App Store / Google Play (subscriptions). These services are governed by their own terms and privacy policies. We are not responsible for the availability, accuracy, or content of third-party services, and your use of them is at your own risk.
12. Modifications to Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will update the “Last updated” date at the top of this page. Your continued use of the app after such changes constitutes acceptance of the modified Terms. If you do not agree with the updated Terms, you should discontinue use of the app.
13. Modifications to Service
We reserve the right to modify, suspend, or discontinue any part of the app at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the app.
14. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
Any dispute arising from or relating to these Terms or the app shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved within 30 days, either party may pursue resolution through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in English.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions shall remain in full force and effect.
16. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding your use of Kaal, and supersede any prior agreements.
